Making Money Ebay


Pocket Gems has raised $5 million in funding from Sequoia Capital and other Silicon Valley luminaries as it competes in the crowded iPhone game market.


The small San Francisco company has had five major hits on the iPhone, even though its founders were still in university when they launched their first game a year ago. The funding from venerable venture capital firm Sequoia is a testament to the rapid growth of the iPhone as a viable platform for making money with games. The funding also included Michael Dearing, an eBay veteran and associate professor at the Stanford University Institute of Design, Jeff Fluhr, co-founder and former chief executives of StubHub, and Omar Hamoui, founder of AdMob. Sequoia partner Jim Goetz will join Pocket Gems’ board.


That’s rarified company for an independent maker of iPhone games with only 11 employees. But Pocket Gems has seen all five of its games hit the top 10 list on the iPhone and have been downloaded more than 15 million times. Daniel Terry, chief executive, and Harlan Crystal, chief technology officer, founded Pocket Gems in 2009 while Terry was still an MBA student at Stanford University. Their first game was Tap Farm for the iPhone, and they’ve followed it up with Tap Store, Tap Jungle, Tap Zoo and Tap Zoo Christmas.


In an interview, Terry said they were in the right place at the right time to take advantage of the emerging virtual goods business model on the iPhone. Just a year ago, Apple launched its in-app purchases, which allowed gamers to buy virtual goods within a game. That turned out to be a much more lucrative business opportunity for many game makers, including Ngmoco, which was acquired for $403 million by Japan’s DeNA. All of Pocket Gems games are free-to-play, where users play for free and pay real money for virtual goods via the in-app purchases.


Goetz said in an interview that Sequoia — which has funded lots of blockbusters from Apple to Electronic Arts — was interested in Pocket Gems because the team was so skillful at building hit games and the technology to go with them. Many game developers outsource the social networking in their games to companies such as OpenFeint. But Terry said that Pocket Gems uses Facebook Connect and has built its own platform for encouraging gamers to share games with their friends.


In the past, venture capital firms focused on Facebook game companies rather than iPhone game companies. But Facebook is now the domain of big companies such as Zynga, CrowdStar, EA Playfish, Disney-Playdom and others. With the Ngmoco purchase, mobile gaming is getting a lot more attention. Smartphones are gaining traction and the overall mobile gaming market could almost double from $6 billion in 2009 to $11 billion in 2015, according to Juniper Research. Much of the increase could come from virtual goods sales.


Terry said the company was profitable within weeks after its founding and remains so today. He also said that revenues are now above a million dollars a month, though he declined to be more specific. The company’s games are available on iOS (iPhone, iPod Touch, iPad) devices and will expand to Android soon. Terry said the company will hire new developers to increase its pace of development.


“The App Store ecosystem has democratized mobile game development,” said Terry, who got his MBA four months ago.”If you have a good game, you can get it in front of tens of millions of players.”

This sweater was given to me after spending the night with Ashton. I no longer have any attachment to this sweater and I am hoping someone else will enjoy it.


So let's go over this. Brittney is selling a sweater she probably bought at Marshalls and spritzed with freshly gargled used douche water for that authentic scent. There's no Ashton pube on it, no jizz stain, nothing. Uh huh. This is just like the "Owned By A Silver Fox" thong that Mah Boo Anderson Cooper passed to me under the table during our romantic dinner at the Olive Garden. The best part is that Brittney's listing is already up to $9,100 with 11 bids (all fake I'm sure). Will somebody please tell Demi to stop cheating on Twitter with eBay?

Making Money Online With


While many people may mock the idea of accepting Facebook friend requests from strangers, that might be just what a long-term drug addict needs. An experiment being run in Amsterdam at the moment is exploring the idea.


Dutch branding agency Lemz has set up drug addict Monica with her own Facebook page. As she makes her way around the Dutch city she wears a bright blue jacket bearing text asking people to befriend her on the social network.


What can this possibly achieve? The idea is that by making friends online, Monica will be able to gain self confidence and new interests that will help inspire her to quit her addiction. On the page, Monica says “Don’t be afraid! If you decide to become my friend you will get an interesting peek into my daily life (with a maximum of two posts a day). I will NEVER ask for money or try to visit you in person. The only thing I will ask from you is your online friendship.”


Mark Woerde of Lemz tells us “It all started when a relative of mine started ikgebruik.nl to help junkies find their way to organisations of help. He asked me to help him to promote his site among drugs users. We soon found out that drugs users really wanted to help making this site a big success. Now the site ikgebruik.nl is run by drugs users, sharing their experiences and scaring of potential new users. What really struck me was that these drugs addicts by doing this felt like humans again. Especially when all news channels reported about this group of junkies now helping others.”


Now it’s hoped the Facebook idea will reaffirm Monica’s faith in humanity and that the idea could scale to more addicts in the city. “There are many many people out there who want to help others and you do not need 5000 friends per addict”, Woerde says.














Making the Pay-What-You-Want Business Model Work



Pay-what-you-want has become an interesting alternative business model online, with bands like Radiohead demonstrating that it can be an even more successful than traditional pricing. The key to success, however, may be the amount of attention you can generate for your campaign. Pay-what-you-want is often a trade-off between a making small number of full-price sales and a large number of sales at what's likely a far lower price. One of the games in the bundle Machinarium, for example, normally sells for $20. But by being part of the Humble Bundle, certainly it sold many times more copies than normal.



Of course, not everyone can generate quite the buzz of Radiohead or Humble Bundle for that matter, and a recent study pointed to another option for helping make pay-what-you-want endeavors successful: combine it with a voluntary payment to charity, and people then tend to give more. Indeed, Humble Bundle customers can flag some of the money to go towards charity - either Child's Play or the EFF - and some of it towards a tip for the Humble Bundle itself.

Making Money Quickly

“Tea Partiers and small-government conservatives expect to see major legislative action right away next year,” Matt Kibbe, president of FreedomWorks, said in an email. “Make no mistake, the new Congressional Freshman Class was elected to control and reduce the size and scope of government.”


The coming vote on the debt limit promises to be even more contentious. The federal government will run out of money early next year unless more borrowing is authorized, and even the most extreme budget slashing proposals out there will still means deficits for at least the medium term. A failure to pass the bill could spark a financial crisis, shut down the government, and turn big business against the GOP, making it a must-pass measure. But it’s also a bill that’s easy to demagogue, as the many Republicans who attacked incumbent Democrats for their votes on increasing the debt limit on the campaign trail discovered this year. The Republican caucus voted unanimously against the last increase in the debt ceiling, and a number have already signaled they won’t authorize another once they’re in the majority. After two years of heated rhetoric on the issue, Boehner is already warning conservatives to cool it.


“This is going to be probably the first really big adult moment for the new Republican majority,” Boehner told The New Yorker in a recent interview. “You can underline ‘adult.’ And for people who’ve never been in politics it’s going to be one of those growing moments. It’s going to be difficult, I’m certainly well aware of that. But we’ll have to find a way to help educate members and help people understand the serious problem that would exist if we didn’t do it.”


Kibbe said the House in January has to prove immediately that it is serious about spending—for example, by joining Sarah Palin in embracing Rep. Paul Ryan’s (R-WI) Social Security- and Medicare-slashing budget plan—if it wants to keep the Tea Party’s support through the vote.


“The majority party has some responsibilities, and I think they should have to confront the unreality of what they have committed themselves to,” said Rep. Barney Frank of the debt-limit fight.

“If nothing is done on the part of the newly elected members of Congress and the first major vote is raising the debt limit, that would be unacceptable,” he told The Daily Beast. “If conservatives make any kind of concessions, there will have to be proof by legislation passed that this situation is not going to happen again. A budget would have to be drafted that is substantially smaller than previous years.”

The Yankees have been doing a lot of waiting this offseason. They waited for Cliff Lee to choose his team. They waited for Derek Jeter to accept their offer. Then they stayed put a while too long and lost out on Zach Greinke. Now they await a decision from Andy Pettitte as to whether or not he will pitch in 2011. 


The Yankees starting rotation for 2011 may be in shambles if Pettitte chooses not to return. A few days ago, Brian Cashman said that he would not pressure Pettitte into making a decision quickly. Now there are reports surfacing that Mariano Rivera may be making a phone call to his long-time teammate to see if he can return to the mound in 2011. 


Cashman is optimistic about 2011 when he spoke, saying that he will bring back a 95-win team next year. Andy Pettitte definitely has to be in the equation for the Yankees to win 95 games next year. 


He excelled this year, but got hurt in the second half of the season. He was not as dominant, but he continued to show some consistency as a dominant veteran of the mound. 


The main factor surrounding the decision as to whether he will return will be money. Pettitte has expressed his desire to spend more time with his family in Texas, but the Yankees need him. 


In the past, the Yankees have been known to disrespect some of its aging stars by not offering so much money on the table. It happened to Bernie Williams and Joe Torre later on wrote about his unhappiness afterwards in The Yankee Years


Andy Pettitte has been a fan favorite for a long time in the Bronx, and seeing him leave due to financial unhappiness seems like the wrong way to end his story. The Yankees should reach into their pockets and put the right amount of money on the table, because the only perfect ending to Andy Pettitte's story is one more World Series Championship. With Pettitte on the team, the ending seems possible.

how to manage personal finances

In the digital age, nobody likes carrying a lot of cash around – I know I don’t, anyway. This can be especially frustrating when you go to keep track of your expenses, who you owe money to, who you lent some to and just where it all goes over the month.

As always, there are a lot of apps out there to help you do various things with your money. There are apps to figure out how to manage your money, oversee expenses, send money to people, keep track of who owes you, and more.

In this article, I’ll show you some of the applications you can take advantage of to do everything I’ve mentioned here, leaving you free to pick and choose the apps that will make your life easier.

How to Manage Your Money

I’m beginning to learn just how difficult managing your expenses can be. For the most part, I use my debit card tied to my checking account to make purchases. I use it at the grocery store, when I go out to lunch with my coworkers and on the weekend when I’m out exploring the city.

At the end of the month, my bank statement looks pretty ridiculous. All of these small transactions make it difficult to sift through. I still know what everything is, but if I wanted to see where I could be saving some money I wouldn’t know the first place to look.

Sounds like you? Even if it doesn’t, you could still reap the benefits of visually being able to manage your money. These apps make the process a lot easier.

Mint

Mint has been on our radar since back in 2007 when Karl wrote about it. Plain and simple, if there is one app I want you to keep in mind it’s this one.

Mint is a free personal finance application that can help you compare your bank accounts, credit cards, CDs, brokerage and 401(k) to the best products out there. It offers a visual representation of your finances and is very easy to set up. Use it to manage your budget, get credit card advice and understand investing.

Thrive

Thrive (directory app) is also a great application if you’re looking for a simple way to keep track of your spending. With Thrive, you get an overall Financial Health score, which is one number that shows you how financially fit you are. It also shows you scores in other areas and offers you advice on how to make improvements.

Thrive breaks down your spending for you and shows you where you can save. Compare your current budget to last month’s, as well as view a six month average and target budgets to follow.

Texthog

Looking for an even simpler way to track expenses? Texthog (directory app) lets you easily store, organize and access your receipts, expense reports and more via text message, the web, your email, iPhone and even Twitter.

A Texthog free account gives one user the ability to track expenses, view unlimited reports and get budget/bill reminders. Take a photo of your receipts and utilize tags and categories to keep track of everything.

Venmo

Speaking of text messages, have you heard of Venmo? Venmo (directory app) is a nice little app that lets you pay and charge friends with your phone. Send and receive secure payments by linking your card to your account. This allows you to settle small loans you give/get by eliminating paper transactions for small amounts of money.

To use Venmo, all you do is create an account. You can then send and receive money to other accounts simply by using text commands in SMS. Accept a “trust” request from your friends and make transactions without having to authorize them by texting a 3 digit code.

This is a pretty solid application that I have been using a lot lately with my friends/coworkers. It’s great for when a bunch of you are out to lunch and not everyone has cash on them. “I’ll just put it on my card and Venmo you all afterwards.”

Owe Me Cash

Owe Me Cash is a nice app I found recently that is also very easy to use. If someone owes you money, you just sign into Owe Me Cash with your Twitter, Facebook, OpenID, or regular account and tell the app about the debt. The app will send automatic reminders to those that owe you money by phone, text and email, so you can get paid!

This app is more fun than serious, but it doubles as an easy way to keep track of who owes you what. Let the app bug your friends to pay you so you don’t have to do it yourself – it’s a win-win.

With recent revelations of the fraudclosure scandal, and a spike in interest toward all things REO, we decided to go back to basics and present some "appendices" over why this process of excess bank inventory clearance is so important and what its implications are, especially in a world in which foreclosing has suddenly become legally impossible.

The Foreclosure Process

The foreclosure process may vary significantly across states and even across countries, but the following description is general enough that it should be applicable to most of the US.

Delinquency and foreclosure. After a homeowner with a mortgage loan has missed three monthly payments, he or she is considered to be “90 days delinquent,” and the servicer of the mortgage (the company to which the mortgage payments are made) can initiate foreclosure proceedings.

Auction. At some point, the borrower will be asked to vacate the home, and if necessary at some later point, the borrower will be compelled to vacate the home by local authorities. The home will then go up for auction.

REO. If the auction bids do not reach a high enough level to cover the outstanding balance of the loan, the lender can take ownership of the property. Once the lender owns the property (referred to as real-estate-owned or REO), it will typically remain vacant until the lender is able to sell it.

As those who have been following our RealtyTrac updates know, in the last quarter the discount between a regular home sale and that in foreclosure just hit an all time record. Here is how the pricing matrix looks like by state and nationally:

And possibly the scariest chart of all: the end buyer of all the REOs, the properties that end up having the lowest salvage value, for the most part end up being acquired by the nationalized GSEs. And since the GSEs are on the US shadow balance sheet, these are simply more "assets" that collateralize US treasurys, and therefore, the US currency.

Take all the data above, and layer on top the complete confusion courtesy of the self-imposed foreclosure moratorium, and the utter confusion in the market becomes apparent.




If you thought robo signing was bad, you ain’t seen nothin’ yet.


The website 4ClosureFraud presents the gory details of a potential major new front in the foreclosure mess. A Pennsylvania foreclosure mill, Goldbeck McCafferty & McKeever, is accused by Patrick Loughren of allowing non-attorneys to file and prosecute foreclosures. A DailyFinance story gives the overview:


Two Pennsylvania cases, one state and one federal, have exposed new types of document problems in foreclosure cases. One of the cases has potentially transformative consequences for thousands of troubled Pennsylvania homeowners. At the center of each is the same law firm: Goldbeck McCafferty & McKeever (GMM)…


As long as a lawyer supervises foreclosure filings, and at least reads them before they’re submitted to the court, that is acceptable. But Loughren is suing because all three named partners of GMM, Joseph Goldbeck, Gary McCafferty and Michael McKeever, have admitted under oath — during depositions last September and in a separate case in December 2009 — that no attorney ever read the filings. The partners made clear that the practice has gone on for the past several years.


If Loughren prevails, this case will prove to be vastly more significant than robo-signing.


Robo signing, while a fraud on the court, does not necessarily invalidate the underlying legal action. Even a punitive judge is far more likely to take action against the lawyers involved in the robo signing or to reject the new corrected affidavits and require them to restart the foreclosure action afresh than dismiss the case with prejudice. Only if the affidavits or other documents were submitted in error would it inevitably disrupt the foreclosure, and in those cases, it OUGHT to present a problem to the party trying to foreclose.


The practice of law by non-lawyers is a far more serious matter. In Pennsylvania it is a crime. In the case against GMM and its apparently unsupervised paralegals, the plaintiff is seeking disgorgement of falsely billed “attorney’s fees”.


But even more important, the lack of attorney involvement would render the foreclosures void. Pennsylvania courts have found “proceedings commenced by persons unauthorized to practice law are a nullity”. Federal courts interpreting Pennsylvania law have supported this point of view.


If Loughren succeeds, the ramifications would be wideranging. For GMM foreclosures, it would cloud the title of the properties sold. The parties who lost their homes could seek recourse. It is unlikely they could reverse the foreclosures. As Bob Lawless noted at Credit Slips:


The law, however, strongly protects the finality of past foreclosure sales.


At first, these rules might seem unfair. Why should the law protect old court proceedings that have been tainted by mistake or, even worse, fraud? The answer, of course, is for the instrumental reason that a court system could not operate where every old judgment was open to attack. Losing parties will almost always feel the judge make a mistake or the opposing party misled the court through half-truths or outright lies. Before a court enters final judgment, procedural rules and court appeals are designed to maximize the possibility the truth will win out and to minimize the possibility of judicial error. The law imposes a very heavy burden on those seeking to attack final court judgments.


The same ideas strongly protect the finality of a court’s foreclosure judgment. The foreclosure judgment, however, is only an interim step to the ultimate disposition of the property at the foreclosure sale and the transfer of the deed. Now, third party rights will come into play, and the need for finality becomes even stronger. If foreclosure deeds were subject to attack, at worse we might have no bidders at the sale, and at best we would have drastically lower prices. Even if the successful purchaser at the foreclosure sale is the lender, it will be selling later to a third party, and we will have the same need for finality.


For these reasons, and not surprisingly, most every (or maybe even every–I’ll let someone else do the 50-state survey) state provides the strongest possible finality protections for deeds obtained through foreclosure sales.


But that does not mean the borrowers do not have other avenues. The logical targets are the foreclosure mills, and perhaps most important, the servicers and trustees. And per the lawsuit:


Plaintiff avers, on information and belief, that the “clients” of the non-lawyers – consisting of banks, loan servicers, REMIC trusts, and other creditors – are all aware that the non-lawyers are engaged in the unauthorized practice of law. The individuals employed at the entities (i.e., at the “clients”) all interact with the Non-Lawyer-Defendants on a day-to-day basis via e-mail and phone and they are aware that the Non-Lawyers are responsile for preparing, signing and filing these foreclosure cases and that the cases are being filed without attorney review.


Proving that the clients knew the paralegals were not supervised might be a stretch, but I suspect that the charge is accurate, particularly since as 4ClosureFraud points out, Bank of America was involved in a case where GMM staff admitted to the lack of attorney supervision and did nothing:


Loughren notes that in both cases involving the partners’ testimony about the practice, Bank of America (BAC) was the foreclosing bank. It was actually present during the December 2009 trial when the admissions were first made. Loughren points out that BofA’s representative at that trial, John Smith, is himself a lawyer, and so presumably understood the legal significance of GMM’s admission.


Other BofA employees surely learned about the practice too, given that the December case was an effort by the U.S. Bankruptcy Trustee to sanction both the bank and GMM for misconduct, and evidence submitted for it showed the involvement of “high-ranking” BofA people not normally involved in a foreclosure, such as its assistant general counsel.


So why is this such a big deal? Non-lawyers practicing law is impermissible in other states.


Most foreclosure mills are run on the same template: impossibly high staff to attorney ratios, 90 or 100 to every attorney. The ratios alone make meaningful supervision impossible. And this high leverage wasn’t due solely to partner greed. Some foreclosure mills, contrary to the laws of many states, had private equity funds as investors. And other foreclosure mills were keen to secure PE monies. So most industry incumbents had the same profile: an extraordinarily high staff to partner ratio, with standardized processes to maximize profits.


As a result, just as with the robo signers, it appears likely that documents were signed improperly. Matt Weidner has examples of signatures from an Ohio law firm by attorney Edward M. Kochalski that are so different that it is pretty implausible that one person signed them all. But here, the ramifications are far more serious.


The Loughren complaint looks solid and has detailed factual allegations.

So where have the state bar associations been? It’s appalling that there have been no sanctions or disbarments over the robo signing scandal. We need to see some lawyers lose their licenses, or better yet, their freedom. Otherwise, it will be clear that the legal profession is siding with its meal tickets rather than the rule of law.

With recent revelations of the fraudclosure scandal, and a spike in interest toward all things REO, we decided to go back to basics and present some "appendices" over why this process of excess bank inventory clearance is so important and what its implications are, especially in a world in which foreclosing has suddenly become legally impossible.

The Foreclosure Process

The foreclosure process may vary significantly across states and even across countries, but the following description is general enough that it should be applicable to most of the US.

Delinquency and foreclosure. After a homeowner with a mortgage loan has missed three monthly payments, he or she is considered to be “90 days delinquent,” and the servicer of the mortgage (the company to which the mortgage payments are made) can initiate foreclosure proceedings.

Auction. At some point, the borrower will be asked to vacate the home, and if necessary at some later point, the borrower will be compelled to vacate the home by local authorities. The home will then go up for auction.

REO. If the auction bids do not reach a high enough level to cover the outstanding balance of the loan, the lender can take ownership of the property. Once the lender owns the property (referred to as real-estate-owned or REO), it will typically remain vacant until the lender is able to sell it.

As those who have been following our RealtyTrac updates know, in the last quarter the discount between a regular home sale and that in foreclosure just hit an all time record. Here is how the pricing matrix looks like by state and nationally:

And possibly the scariest chart of all: the end buyer of all the REOs, the properties that end up having the lowest salvage value, for the most part end up being acquired by the nationalized GSEs. And since the GSEs are on the US shadow balance sheet, these are simply more "assets" that collateralize US treasurys, and therefore, the US currency.

Take all the data above, and layer on top the complete confusion courtesy of the self-imposed foreclosure moratorium, and the utter confusion in the market becomes apparent.




If you thought robo signing was bad, you ain’t seen nothin’ yet.


The website 4ClosureFraud presents the gory details of a potential major new front in the foreclosure mess. A Pennsylvania foreclosure mill, Goldbeck McCafferty & McKeever, is accused by Patrick Loughren of allowing non-attorneys to file and prosecute foreclosures. A DailyFinance story gives the overview:


Two Pennsylvania cases, one state and one federal, have exposed new types of document problems in foreclosure cases. One of the cases has potentially transformative consequences for thousands of troubled Pennsylvania homeowners. At the center of each is the same law firm: Goldbeck McCafferty & McKeever (GMM)…


As long as a lawyer supervises foreclosure filings, and at least reads them before they’re submitted to the court, that is acceptable. But Loughren is suing because all three named partners of GMM, Joseph Goldbeck, Gary McCafferty and Michael McKeever, have admitted under oath — during depositions last September and in a separate case in December 2009 — that no attorney ever read the filings. The partners made clear that the practice has gone on for the past several years.


If Loughren prevails, this case will prove to be vastly more significant than robo-signing.


Robo signing, while a fraud on the court, does not necessarily invalidate the underlying legal action. Even a punitive judge is far more likely to take action against the lawyers involved in the robo signing or to reject the new corrected affidavits and require them to restart the foreclosure action afresh than dismiss the case with prejudice. Only if the affidavits or other documents were submitted in error would it inevitably disrupt the foreclosure, and in those cases, it OUGHT to present a problem to the party trying to foreclose.


The practice of law by non-lawyers is a far more serious matter. In Pennsylvania it is a crime. In the case against GMM and its apparently unsupervised paralegals, the plaintiff is seeking disgorgement of falsely billed “attorney’s fees”.


But even more important, the lack of attorney involvement would render the foreclosures void. Pennsylvania courts have found “proceedings commenced by persons unauthorized to practice law are a nullity”. Federal courts interpreting Pennsylvania law have supported this point of view.


If Loughren succeeds, the ramifications would be wideranging. For GMM foreclosures, it would cloud the title of the properties sold. The parties who lost their homes could seek recourse. It is unlikely they could reverse the foreclosures. As Bob Lawless noted at Credit Slips:


The law, however, strongly protects the finality of past foreclosure sales.


At first, these rules might seem unfair. Why should the law protect old court proceedings that have been tainted by mistake or, even worse, fraud? The answer, of course, is for the instrumental reason that a court system could not operate where every old judgment was open to attack. Losing parties will almost always feel the judge make a mistake or the opposing party misled the court through half-truths or outright lies. Before a court enters final judgment, procedural rules and court appeals are designed to maximize the possibility the truth will win out and to minimize the possibility of judicial error. The law imposes a very heavy burden on those seeking to attack final court judgments.


The same ideas strongly protect the finality of a court’s foreclosure judgment. The foreclosure judgment, however, is only an interim step to the ultimate disposition of the property at the foreclosure sale and the transfer of the deed. Now, third party rights will come into play, and the need for finality becomes even stronger. If foreclosure deeds were subject to attack, at worse we might have no bidders at the sale, and at best we would have drastically lower prices. Even if the successful purchaser at the foreclosure sale is the lender, it will be selling later to a third party, and we will have the same need for finality.


For these reasons, and not surprisingly, most every (or maybe even every–I’ll let someone else do the 50-state survey) state provides the strongest possible finality protections for deeds obtained through foreclosure sales.


But that does not mean the borrowers do not have other avenues. The logical targets are the foreclosure mills, and perhaps most important, the servicers and trustees. And per the lawsuit:


Plaintiff avers, on information and belief, that the “clients” of the non-lawyers – consisting of banks, loan servicers, REMIC trusts, and other creditors – are all aware that the non-lawyers are engaged in the unauthorized practice of law. The individuals employed at the entities (i.e., at the “clients”) all interact with the Non-Lawyer-Defendants on a day-to-day basis via e-mail and phone and they are aware that the Non-Lawyers are responsile for preparing, signing and filing these foreclosure cases and that the cases are being filed without attorney review.


Proving that the clients knew the paralegals were not supervised might be a stretch, but I suspect that the charge is accurate, particularly since as 4ClosureFraud points out, Bank of America was involved in a case where GMM staff admitted to the lack of attorney supervision and did nothing:


Loughren notes that in both cases involving the partners’ testimony about the practice, Bank of America (BAC) was the foreclosing bank. It was actually present during the December 2009 trial when the admissions were first made. Loughren points out that BofA’s representative at that trial, John Smith, is himself a lawyer, and so presumably understood the legal significance of GMM’s admission.


Other BofA employees surely learned about the practice too, given that the December case was an effort by the U.S. Bankruptcy Trustee to sanction both the bank and GMM for misconduct, and evidence submitted for it showed the involvement of “high-ranking” BofA people not normally involved in a foreclosure, such as its assistant general counsel.


So why is this such a big deal? Non-lawyers practicing law is impermissible in other states.


Most foreclosure mills are run on the same template: impossibly high staff to attorney ratios, 90 or 100 to every attorney. The ratios alone make meaningful supervision impossible. And this high leverage wasn’t due solely to partner greed. Some foreclosure mills, contrary to the laws of many states, had private equity funds as investors. And other foreclosure mills were keen to secure PE monies. So most industry incumbents had the same profile: an extraordinarily high staff to partner ratio, with standardized processes to maximize profits.


As a result, just as with the robo signers, it appears likely that documents were signed improperly. Matt Weidner has examples of signatures from an Ohio law firm by attorney Edward M. Kochalski that are so different that it is pretty implausible that one person signed them all. But here, the ramifications are far more serious.


The Loughren complaint looks solid and has detailed factual allegations.

So where have the state bar associations been? It’s appalling that there have been no sanctions or disbarments over the robo signing scandal. We need to see some lawyers lose their licenses, or better yet, their freedom. Otherwise, it will be clear that the legal profession is siding with its meal tickets rather than the rule of law.
